Occupancy permits and contractual delivery

A recent judgment on contractual delivery and occupancy permits in land-share construction.

The dispute concerned the contractor’s claim for the price of two units under a construction contract in return for land share. The General Assembly held that tying contractual delivery to an occupancy permit constitutes a written evidence agreement. Where turnkey delivery is required, contractual delivery is not completed without that permit.
