Concealment of transfers from heirs

The majority treated years of care and support given to the deceased and his spouse as relevant consideration for the transfer to the daughter-in-law. Concealment from the heirs was not proved in this case; the judgment allowing the claim was reversed because it should have been dismissed.

The deceased transferred shares in ten properties to his son under a lifetime-care agreement, leaving only one property of very low value. Following an earlier reversal finding an intent to conceal assets from heirs, cancellation and registration in the heirs’ names were upheld. Reserved shares

A reserved-share violation cannot be assessed only by examining the properties covered by a will. The entire estate, including assets outside the transfers, must be investigated and the net estate and abatement ratios determined. Divisibility must be considered before the relevant election arises; incomplete investigation required reversal.

Omitting bank funds, failing to clarify a parcel’s identity and not calculating an individual abatement ratio for each defendant required reversal. A defendant’s own reserved share must be taken into account. For the monetary abatement of indivisible assets in this case, expropriated properties were to be assessed by reference to the expropriation proceeds rather than a current property valuation.

Rejection of inheritance

Official records established that liabilities at the date of death exceeded estate assets and that the heirs had not acted in a way amounting to acceptance. The court upheld judicial rejection under Civil Code Article 605(2), finding no conduct that extinguished the right to reject under Article 610.

An unconditional actual rejection under Civil Code Article 605(1) falls within the jurisdiction of the civil peace court. Mentioning insolvency in the petition does not by itself turn that request into an action for judicial rejection. The judgment declining jurisdiction on that basis was reversed.
